The Department of Justice (DOJ) is continuing to pursue meritless cases against Chinese-American scientists.

In April 2021, the DOJ indicted Mingqing Xiao, a mathematics professor and researcher at Southern Illinois University (SIU) for two counts of wire fraud and one count of making a false statement as part of the “China Initiative.”
He was acquitted of all charges in the original indictment filed in April 2021. However, he was found guilty on four tax charges – three counts that he did not check the box on 3 years of his taxes indicating that he had a foreign bank account, and one count that he did not file a Foreign Bank Account Report.
For that conviction, the DOJ recommended one year in prison and a $50,000 fine. The judge sentenced him to one year probation and a $600 fine.

Prosecutors charged Franklin Tao with concealing his work with a Chinese university and his affiliation with a Chinese government-backed talent program. The Department of Justice also charged that Tao attempted to defraud the University of Kansas and the U.S. government of grant money by failing to fill out conflict-of-interest forms while he was doing work for Fuzhou University in China.  The judge dismissed 3 of the 4 charges because there was no evidence that Tao obtained money or property through the alleged scheme to defraud, as required under the wire fraud statute.  She did however let stand a lesser charge of making false statements.

Lenny the liberal here. Asian Americans sued Harvard for racial discrimination. If you were Asian American and had high test scores and grades, Harvard rejected you. But if you were black or Hispanic and had the exact same test scores and grades, Harvard would admit you. Now the Supreme Court might hear the lawsuit and may rule against Harvard. What should we do? Harvard is making the SAT optional! That way, we can continue to discriminate against Asian Americans without being sued!

SACRAMENTO — Proposition 209 of 1996 is a part of CA’s Constitution. It prohibits state government institutions from considering race, sex, or ethnicity, specifically in the areas of (1) public employment, (2) public contracting, and (3) public education.
Lawmakers and civil rights groups said Tuesday they would try to repeal Proposition 209. They will ask the Legislature to put Assembly initiated Constitutional Amendment No. 5 (ACA5) on the November ballot. It would strip language from the state Constitution prohibiting universities, schools and government agencies from using race or sex in their admissions criteria, hiring and procurement decisions.  Assemblywoman Shirley Weber, the San Diego Democrat is sponsoring the measure.
It must pass both the Assembly and the Senate with a two-thirds vote by the end of June to qualify for the ballot in 2020. Voters could then repeal Prop. 209 by a simple majority.
Proposition 209 passed with nearly 55% of the vote in 1996.
The Legislature last considered the issue in 2014, when a proposed constitutional amendment that would have asked voters to reverse the ban on consideration of race and sex in college admissions passed the Senate before being caught up in complex racial politics.
Concerned that it would limit their children’s ability to get into California’s most selective colleges, Asian American groups mobilized against the measure. Their campaign included town hall meetings across the state and a drive to re-register Asian American Democrats as Republicans. That led three Asian American state senators who had already voted for the proposal to ask legislative leaders to hold it.

Dr Norman Wang, Director of University of Pittsburgh Medical Center Cardiology fellowship program, was removed from his position simply because he published an objective, scholarly, peer-reviewed white paper discussing the pros and cons of including race as part of the selection criteria for the Cardiology fellowship program.

  2. Is this a Democrat Party ‘thing’ or is it just that these most regrettable things happen to be happening on Obama’s watch.

    I can argue that if Obama was really for racial unity, he’d have his people be more careful in taking these actions.

    Would a Republican administration do any better?

    The Democrats appear to be ‘flubbing it’….in football, if your team can’t move the ball forward ten yards in four plays, the ball goes over to the other team, and they get a crack at trying to move it forward ten yards in four plays. I may be belittling the injustice of the situation; my apologies for doing so. The point is, let’s give the other team (a.k.a. the Republicans) a chance with the ball and see if they ‘flub it’.

Note: for all of his embarrassing (especially to Republicans and right-leaning libertarians like me) talk about Hispanics and Muslims, I don’t recall that Donald Trump has had much to say, good or bad, about Asian-Americans. He has denounced what he asserts are ‘bad trade deals’, but that’s about all I’ve heard. Maybe I’ve missed it, in all of the furor over his ‘asking the Russians to find Hillary’s 30,000 missing e-mails’, or his assertion that ‘President Obama started Isis (he may have enabled it to become what it is today, but it wasn’t his idea) or even going back to his spat with Megyn Kelly.

    Anyone with knowledge along these lines, comment here and enlighten my ignorance…

  6. Looking at Don Joe’s post of July 24 of last year, methinks maybe I ought to read those ‘Hall of Shame’ entries and see what Republicans have done.

    Be aware that my own political leanings are libertarian…I tend to side with the Republicans on fiscal issues and either side with the Democrats or remain neutral on social issues. For instance, I try to ‘look the other way’ on gay marriage.

  7. Most Asian Americans vote Democrat now so they expect the worse from Trump: hostile immigration policies, repealing Obamacare and fraying welfare programs. Republican Asian Americans may hope for less discrimination against Asian American applicants to universities, less onerous regulation of businesses, and more support for Taiwan.

  8. The hot-button issues, as you can plainly see for yourself, involve Hispanics from south of the Rio Grande, and Muslims in general. I note that in history people have been suspicious of Catholics. I myself need to take a closer look at the conflicts between Catholics and Protestants in history – the English-Spanish conflict that led to the Spanish Armada, the Thirty Years’ War in Germany, and other situations.

    I think, repeat, think I understand the threat of Islamic terrorists infiltrating into the U.S. with the mass of refugees. I think, repeat, think, I understand the threat of Muslims trying to impose their religion on the world. I hate religious fanatics in general, regardless of denomination, though not intensely. preach to me if you will, but let me worship according to the dictates of my own conscience in the end… even if I ‘elect’ not to worship at all. I do happen to be an evolutionist. (Calling myself a ‘Darwinist’ might cause people to think I pray to Charles Darwin, which sounds a little bit crazy, don’t you think?)

  9. I see that February seems to be Black History Month. Is there an Asian-American History Month? How ’bout a mini-series on the internment of Japanese-Americans in World War Ii that we can put up against both versions of ‘Roots’. (I’m of 50% Sicilian extraction, and the only depictions I see of ‘my people’ on the big and small screen are as mobsters.)

  10. Asian American and Pacific Islander Heritage Month, takes place in May. There are several documentaries about the Japanese-American internment, including “Resistance at Tule Lake”. Movies include Go for Broke! (1951) and Come See the Paradise (1990)
